Privacy Policy

Last updated: March 26, 2026

Welcome to Motion MKTG ("we," "us," or "our"). This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you visit our website (motionmktg.com), purchase products, or use our services. This policy complies with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), Canada's Anti-Spam Legislation (CASL), applicable provincial privacy legislation, the U.S. CAN-SPAM Act, and relevant U.S. state privacy laws.

1. Information We Collect

When you interact with Motion MKTG — through our website, forms, purchases, or services — we may collect the following:

Information You Provide Directly

  • Your name, email address, and phone number
  • Business name, website URL, industry, and location (city, state/province)
  • Social media profiles and other business details submitted through our forms
  • Service preferences, marketing goals, and platform usage information
  • Payment information (processed securely by Stripe — we never see, store, or have access to your full card number, CVV, or billing details)
  • Any other information you voluntarily provide through contact forms, booking requests, or audit purchases

Information Collected Automatically

  • Browser type, device type, operating system, and IP address
  • Pages visited, time on site, click paths, and referral source
  • Interaction data collected via Google Analytics and Meta Pixel
  • Cookie and tracking data (see Section 5)

Information Collected for SEO Audit Reports

  • When you purchase an SEO Audit Report, we collect your business name, website URL, city, state/province, industry, full name, phone number, and email address
  • This information is sent to our AI analysis engine (powered by Anthropic's Claude API) which performs web searches using publicly available data to generate your audit
  • The audit analyzes publicly available information about your business including Google Business Profile data, online reviews, social media presence, website technical characteristics, and competitor information
  • Your business information and audit results are stored in our CRM system (GoHighLevel) for service delivery and follow-up

2. How We Use Your Information

We use your information only for the purposes for which it was collected, or for purposes you would reasonably expect:

  • To respond to your inquiries and provide the services you've requested
  • To generate and deliver SEO Audit Reports based on publicly available business data
  • To process payments for services purchased through our website via Stripe
  • To communicate with you regarding your purchases, bookings, or service inquiries
  • To send marketing communications, updates, newsletters, or promotional offers — only if you have provided express consent (opt-in)
  • To store your contact information in our CRM for relationship management and service delivery
  • To improve our website, services, and understand how visitors use our platform
  • To comply with legal obligations, including tax and accounting requirements

We do not use your personal information for automated decision-making or profiling in a way that produces legal or significant effects on you.

3. Consent & CASL Compliance

In compliance with Canada's Anti-Spam Legislation (CASL) and the U.S. CAN-SPAM Act:

  • We only send commercial electronic messages (emails, SMS) to individuals who have provided express consent through our website forms
  • Every form on our website that collects contact information includes a clear consent checkbox that you must actively check before submitting
  • All marketing emails include a clear and functional unsubscribe link that is honored within 10 business days
  • Transactional messages (e.g., payment confirmations, audit report delivery) do not require separate marketing consent, as they relate directly to a purchase or service you initiated
  • We maintain records of consent including the date, time, and method of opt-in
  • You may withdraw consent at any time by clicking "unsubscribe" in any email, or by contacting us directly

4. How We Share Your Information

We do not sell, rent, or trade your personal data to third parties. We may share your information in the following limited circumstances:

  • Stripe (Payment Processing): Your payment information is processed directly by Stripe Inc. We never receive or store your credit card details. Stripe's privacy policy applies to payment data: stripe.com/privacy
  • Anthropic (AI Audit Generation): Your business name, website URL, location, and industry are sent to Anthropic's Claude API to generate SEO Audit Reports. Anthropic processes this data solely to fulfill your request and does not use it for training. Anthropic's privacy policy: anthropic.com/privacy
  • GoHighLevel (CRM & Email): Your contact and business information is stored in our GoHighLevel CRM for relationship management, automated email delivery, and service follow-up
  • Google Analytics & Meta Pixel: Anonymized usage data for website analytics and advertising optimization
  • Legal requirements: If required by law, court order, subpoena, or governmental authority in Canada or the United States
  • Business transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred with appropriate notice and continued protection

All third-party service providers are contractually required to handle your data in accordance with applicable privacy laws and solely for the purposes we specify.

5. Cookies & Tracking Technologies

We use cookies and similar tracking technologies to:

6. Data Storage & Cross-Border Transfers

  • United States — where certain service providers (Stripe, Anthropic, GoHighLevel, Google) process data

By using our website and services, you acknowledge and consent to the transfer of your personal information to the United States and other jurisdictions where our service providers operate. These transfers are made in compliance with PIPEDA's requirements for cross-border data transfers, and all service providers are contractually bound to protect your data.
